Owners: Edie TarrellPiggy: Rosevelt
Date they won: Feb 15 2005

Here's their story:

Well I guess you could say we won this one. Edie went to court yesterday and just got a fine for noise only because they had to fine her for something . There were so many tickets, and as far as we can figure out when the found out there was going to be an attorney they some how forgot the charges that she had farm animals. Not only the charges but the scheduled hearing on Jan 28th. I am really baffled on this one. They didnt even give her a chance to present any of the things I sent to her, and the hearing officer told her that there was no law about the potbellied pig in the city of Philadelphia so her pets were ok ,and there could not be any charge against her for having farm animals because potbellied pigs were pets. Then it was dismissed. So as far as we can tell for now because there is absolutely no law that specifically mentions the potbellied pig in the City of Philadelphia Pa ., nobody can be made to relinquish their pet potbellied pig. This is just another example of an attorney being useless for saving homes for potbellied pigs , It is a good thing he was Pro Bono . The scare tactics being used to harass potbellied pig owners into disposing of their pet pig just because somebody says so. They had absolutely no right to even charge the person for having livestock when they knew right well the pot was not livestock. It is imperative that pet pig people know ,that they not only can fight City Hall ,but they can win. There are absolutely no laws on the books about potbellied pigs in any municipality unless someone has gone to the trouble to put one there. The laws that are there are usually most restrictive as far as size of the pig as well as the number of pigs allowed. even the size of the yard is restrictive in a lot of codes but we can get around that one too if need be. >>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>> Below is the letter fron the attorney about the win >>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>> SAMUEL C. STRETTON ATTORNEY AT LAW 301 S. HIGH STREET 834 CHESTNUT STREET PHilADELPHIA. PENNSYLVANIA 12151627-8653 February 16, 2005 Edie Tirrill 5 Penn Street Philadelphia, PA 19124 Dear Edie Thank you for letting me represent you. I think you had a great victory. They dismissed all the cases involving having a pig. Obviously the argument was that the pig was not a farm animal but a pet and/or an animal for entertainment. The dismissal clearly confirms that. You were found guilty of four of the nuisance violations for feeding the cats and the smell from the pig. I understand you are taking the corrective steps. I will close 0 the file now but if you or the others ever want me to challenge or go further let me know but I could not represent you for free anymore and would have to charge my norm 1 hourly rate. I will await your advice. Very Truely Yours Samuel C. Stretton
